Terms of Service — Nesteries

These Terms of Service ("Terms") govern your use of the Nesteries service (the "Service"), operated by Nikita Kutsakivskyi ("Nesteries," "we," "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement. We do not knowingly allow minors to use the Service.

2. Your account

  • You sign in via Google. You are responsible for keeping your Google account secure.
  • You must provide accurate information in your profile. Impersonating another person or creating a fake profile is prohibited.
  • One account per person.
  • You may delete your profile at any time from Settings. See our Privacy Policy for what deletion does and does not remove.

3. What the Service is (and isn't)

Nesteries helps you discover and connect with potential roommates/matches based on the information you and other users provide. We do not verify the identity, intentions, background, or trustworthiness of users beyond the limited student-email verification badge described in the app (which confirms an email domain, not identity). You are solely responsible for your own safety when communicating with or meeting other users. We strongly recommend:

  • Meeting in public places for the first time.
  • Not sharing sensitive financial or personal information with matches.
  • Reporting suspicious behavior via the in-app Report feature.

We do not guarantee that you will find a roommate, a match, or that any match will be suitable, safe, or trustworthy.

4. Acceptable use

You agree not to:

  • Harass, threaten, or abuse other users.
  • Post hateful, discriminatory, or illegal content.
  • Create fake profiles or misrepresent your identity, age, or intentions.
  • Use the Service for spam, scams, solicitation, or commercial advertising not related to housing/roommate matching.
  • Attempt to access another user's account, scrape the Service, or interfere with its normal operation.
  • Upload content you do not have the right to share, or content that infringes someone else's rights.

We may investigate reports made through the in-app reporting feature and take action, including warnings, content removal, or account suspension/termination, at our discretion.

5. Content you submit

You retain ownership of the photos, bio, and other content you submit. By submitting content, you grant us a limited, non-exclusive license to store, display, and transmit that content as necessary to operate the Service (e.g., showing your profile to other users, delivering your messages to your matches).

You are responsible for ensuring you have the right to share any content you upload (e.g., that a photo doesn't infringe someone else's copyright or depict someone without consent).

6. Messages

Messages you send are delivered to your matches and remain accessible to them even if you later delete your profile, since we do not delete messages from the recipient's side of a conversation. Do not send anything you would not want retained.

7. Verification badges

The "verified student" badge confirms that a message was sent from an email address on a recognized institutional domain. It is not a full identity verification and should not be relied upon as proof of who a person actually is.

8. Termination

  • By you: you may stop using the Service and delete your profile at any time.
  • By us: we may suspend or terminate your account if you violate these Terms, engage in behavior that harms other users or the Service, or if required by law. Where reasonably possible, we will explain the reason.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by applicable law, Nesteries is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to harm arising from interactions with other users, whether online or in person. This limitation does not exclude liability that cannot be excluded under applicable law (e.g., for intentional misconduct or gross negligence, where the law does not permit exclusion).

11. Changes to the Service and these Terms

We may modify or discontinue the Service, or update these Terms, at any time. Material changes to these Terms will be announced in the Service. Continued use after changes take effect means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of Poland, without regard to conflict-of-law principles. Any dispute arising from these Terms will be subject to the jurisdiction of the competent Polish courts, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence, where applicable.
